Although CR attempts to provide accurate information, inaccuracies or errors may occur and CR reserves the right to make corrections and changes to the Site without notice. This disclaimer specifically includes but is not limited to any 1) warranties concerning the availability, accuracy, appropriateness, timeliness, or usefulness of the content of the Site; 2) warranties of non-infringement; and 3) warranties of merchant ability or fitness for a particular purpose.
By using the Site, you agree that this use is at your sole risk. Except as otherwise provided under applicable law, CR, its directors, officers, employees, affiliates, or any party involved in creating or hosting this site will not be liable for any damages arising out of or related to the use of the Site, the inability to use the Site, or to the use of any site linked to the Site. If any of the Terms are deemed invalid, void, or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision shall be severed from the Terms and shall not affect the validity and enforce ability of the remaining Terms, which will remain in full force and effect.
No action arising from your use of the Site, regardless of form, may be brought more than one year after the cause of action has arisen.
Registration is not required to place an order, but registering with the Site enables CR to provide an enhanced customer experience. When registering, you agree that the information you provide is true, accurate, and current and that you will update this information as required to ensure it remains current. You may not impersonate another person when registering. CR reserves the right to suspend or terminate your use of the site and your ability to order items via the Site should CR believe that any of the registration information you provided is untrue, inaccurate, or out of date.
Placing an Order
When you add an item to your shopping bag, you may continue shopping or proceed to checkout. Once CR receives your order, you will receive an email acknowledging the details of your order. This email is not an order confirmation, but merely a recognition that CR has received your requested order.
Once your order has been placed, CR is not able to modify or cancel your order. However, CR reserves the right to decline your order if it cannot obtain authorization for payment, if at least one of the requested items is not in stock, or if it does not ship to the requested destination.
All orders are subject to availability. Although we make every effort to ensure that featured pieces are in stock, occasionally we may sell out of featured items. Note that items in your shopping bag are not reserved and may not be available when you check out if, for example, they are purchased by other clients. If we are unable to complete your order we will usually attempt to notify you within 5 business days. You will not be charged for orders that cannot be fulfilled.
All payments shall be via PayPal. Note that you may pay via your credit card by linking it to PayPal. All prices, taxes, and shipping costs are expressed in United States dollars.
CR does not charge sales tax except for orders to be delivered to addresses in the state of Michigan, where Michigan’s 6% sales tax shall be added.
Order Processing and Shipping Timeline
All orders are processed only Monday through Friday. Order processing may be delayed if CR’s staff is temporarily unavailable to process orders.
Your order will only be shipped once payment and delivery details have been approved. Generally, this will be within 1-3 business days after receiving payment. However, on occasion, order processing may be delayed due to staff availability.
Once we have shipped your order, you will receive an email update with shipping details.
CR cannot be held responsible for unanticipated delays in fulfilling your order.
Shipping Methods and Costs
Except when special arrangements are made, all shipments shall be via “DHL Express” with tracking number. Shipping costs are included in the shopping bag check out process.
Generally, delivery will occur within 3-6 business days. Shipping costs $28 for orders under $80, $15 for orders $80-$179, and free for orders of $180 or above.
If you require other delivery options, please contact CR and we will do our best to accommodate your request.
Orders may not be shipped to P.O. boxes or to APO/FPO addresses.
Items may be exchanged for store credit in the amount of the purchase price of the items (not including shipping costs or taxes) if CR is notified and items are shipped back in their original condition within 3 business days of receipt of delivery. Store credit will become available when the returned items are received by CR and their condition is confirmed. Return shipment and its costs are the responsibility of the buyer. The buyer is responsible for any items lost or damaged during return shipment, or for any costs incurred from late returns or from the return of items not in their original condition. Special orders or sale items are not returnable.
All content used on the Site, including but not limited to text, graphics, logos, images, audio clips, and their arrangement on the Site, is the protected property of CR. Redistribution or republication of any part of the Site or its content, including via framing or linking, is prohibited without the express prior written consent from CR. The items for sale on the site are also protected by copyright.
You may electronically copy or print hard copies of pages from the Site for your personal and non-commercial use related to shopping via the Site.
CR does not want to receive confidential or proprietary information or trade secrets through the Site. This includes but is not limited to jewelry designs. Any information sent to the Site shall be deemed non-confidential and by submitting it you grant CR an irrevocable and unrestricted license to use, modify, reproduce, transmit, display, and distribute it for any purpose with no payment or compensation to you.
The trademarks or trade dress of CR and of the Site may not be used without the express prior written permission of CR. Trademarks or trade dress includes the Caroline Roussel name and logo and the names of products.
Failure of CR to insist upon strict performance of the Terms or any other agreement with you shall not constitute a waiver and shall not reduce your obligations.
Disputes and Applicable Law
CR is owned and controlled from within the state of Michigan, United States of America. By visiting the Site, you agree that the laws of the State of Michigan and United States federal law shall govern your use of the Site, any transactions undertaken by you via the Site, and any other disputes that shall arise between you and CR without regard to the conflict of law rules.
Any disputes arising from your use of the Site or purchases via the Site shall be submitted to confidential binding arbitration in Midland, Michigan. The arbitrator’s award may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by law no dispute arising from your use of the Site or purchases via the site shall be joined to arbitration proceedings involving any other party.
CR reserves the right to pursue injunctive or other relief in state or federal court in Michigan if you have violated or threatened to violate CR’s intellectual property rights. You consent to personal jurisdiction and venue by such courts.
CR may require your cooperation in efforts to identify fraudulent activities. You agree to cooperate with such efforts. You also agree that if you or others acting on your behalf are suspected of fraud or of breaching the Terms, CR may, at its sole discretion, declare you to be in breach of the Terms, suspend or terminate your use of the Site, and seek protection to the fullest extent of the law.
You agree to defend, indemnify, and hold harmless CR, its affiliates, and its officers, directors, and agents from any and all claims, liabilities, costs (including reasonable legal and accounting fees), and expenses arising in any way from your use of the Site, your violation of the Terms, or the posting or transmission of any materials via the Site.
The Terms constitute the entire agreement between you and CR and supersede any prior agreements between you and CR. In the event of inconsistencies between the Terms and any other materials, the Terms will always control.
Caroline Roussel L.L.C. (“CR”) is committed to protecting your privacy. To provide you with excellent customer service, CR gathers, uses, and shares certain personal information collected via CarolineRoussel.com (the “Site”).
Personal information collected may include your name, address, telephone number, email address, product preferences, and billing information. CR also retains details of your transactions with us.

No part of the Site is directed to children under the age of 13. CR will not knowingly collect personal information on any child under the age of 13. To place an order, you must be at least 18 years old and have legal capacity to enter into a contract.
